A Success Story of  A Reader of AllBankingSolutions.com

A few days back we received an interesting email from Mr Ravi Bhushan Kumar Sinha, who is a regular contributor to our website and has been guiding our readers who approached him.   In the email he has given an interesting success story of one of our readers.  

 

Mr Sinha says in the email :-

“A reader of AllBankingSolutions.com sent me the mail alongwith attachment SHOWING THAT  ALLBANKINGSOLUTIONS.COM HAS A TREMENDOUS ROLE TO ENLIGHTEN THE BANKERS AT VARIOUS LEVEL".

 

Mr Sinha further says I am just forwarding a message to enable the bank employee to fight for their rights and do not bow down to their Bank's injustice made through various means”. 

Now some details of the success story :

 

One of the retired banker, Mr. Moti Ram Garg was paid gratuity based on wrong calculations by Syndicate Bank.   Not satisfied with the bank's calculations, he read certain articles on this website and contacted Mr Sinha, who is well versed in these matters.    Mr Sinha enlightened him about various provisions.   Based on such information, Mr Garg approached Syndicate Bank but failed to get a relief inspite of seeking information under RTI.    Syndicate Bank merely replied "As per IX Bipartite settlement dated 27.4.2010, Clause 6, under 'Note", the increment component of FPP as given in column of 2 schedule IV shall, rank for superannuation benefits. That is why the Bank is not adding DA in FPA in the payment of gratuity".

This normally happens as Banks do not care about views of the retired bankers.

 

Undettered, Mr Garg again contacted Mr Sinha, who again appraised him to provisions of Payment of Gratuity Act and informed that actual amount of freezed DA on FPP will be added to emoluments for the purpose of calculation of gratuity amount.    Now Mr Garg made an application under RTI to Allahabad Bank and got the reply that they are adding DA of FPP into the emoluments for the purpose of payment of Gratuity under Payment of Gratuity Act 1972.

 

 

Mr Garg has further added that the letter was sent to Head Office of Syndicate Bank but the Bank still refused.  When heI made an application to Dena Bank, they confirmed (Vide their letter dated 19.6.12- copy attached with this mail) that they are adding full FPP i.e  BP+DA+HRA into the emoluments for the purpose of payment of Gratuity under Payment of Gratuity Act 1972 to the officers in their bank. In support, they have forwarded a copy of IBA circular dated 20.6.2001 (Copy attached with this mail) for your ready reference.

 

Mr Garg further  writes "Thereafter, I made RTI applications to all Nationalised Bank and State Bank Group Banks.  Most of the Banks are adding DA. All such replies were forwarded to Syndicate Bank. Ultimately Syndicate Bank agreed to add DA".  He further says "It is my success story"
